(The legal basis for condominiums)


The State of Hawaii, through it’s Condominium Property Act, provides the legal framework for creation of condominium associations. Hawaii Revised Statutes 514A defines three documents necessary for governance of condominium associations.

DECLARATION   The Declaration is a document that defines the project and divides the property into separate apartment units. This document defines ownership interests and restrictions on use.

BYLAWS   The Bylaws establish rules for the operation of the project. This document details election procedures, board powers, the meeting process, and insurance requirements.

House Rules govern the control of common elements in the project. This document defines guidelines and limits on the behavior of owners, tenants, and guests.
